Gratuity Calculation in UAE: Formula with Examples (2026)

End-of-service gratuity is the UAE's answer to a pension for expatriate workers: a lump sum your employer must pay when your employment ends. It is a legal entitlement under Federal Decree-Law No. 33 of 2021, not a bonus and not discretionary, yet a remarkable number of employees leave money on the table because they never learned the formula. Here it is, with real numbers.
The Basic Formula
Gratuity for expatriate employees who complete at least one year of continuous service:
- 21 calendar days of basic salary for each of the first 5 years of service.
- 30 calendar days of basic salary for each year beyond 5 years.
- The total may not exceed 2 years of total wages.
- Partial years after the first full year are paid pro rata.
Two definitions make or break the calculation:
- Basic salary means your last drawn basic wage, excluding housing allowance, transport allowance, utilities, bonuses and any other add-ons. This is why the basic-versus-allowances split in your contract matters enormously.
- Daily wage is calculated as monthly basic salary divided by 30.
So the practical formula per year of service (first 5 years) is: basic salary divided by 30, multiplied by 21. That works out to 0.7 of one month's basic salary per year served.
Worked Example 1: Three Years of Service
Fatima worked 3 years exactly, with a final basic salary of AED 6,000 per month (her full package was AED 9,500 including housing and transport, but only basic counts).
- Daily wage: 6,000 divided by 30 = AED 200.
- 21 days per year: 200 x 21 = AED 4,200 per year.
- 3 years: 4,200 x 3 = AED 12,600 gratuity.
Worked Example 2: Seven and a Half Years of Service
Rajesh worked 7 years and 6 months, final basic salary AED 10,000 per month.
- Daily wage: 10,000 divided by 30 = AED 333.33.
- First 5 years at 21 days: 333.33 x 21 x 5 = AED 35,000 (roughly).
- Next 2 years at 30 days: 333.33 x 30 x 2 = AED 20,000.
- Final 6 months at 30 days pro rata: 333.33 x 30 x 0.5 = AED 5,000.
- Total: approximately AED 60,000 gratuity.
Worked Example 3: The Ten-Month Employee
Maria resigned after 10 months. Because she did not complete one full year of continuous service, her gratuity is zero. This one-year threshold is the single most important eligibility rule: at month 11, an employee has no gratuity entitlement; a month later, the entire first year vests.
Worked Example 4: Long Service and the Two-Year Cap
Ahmed served 22 years with a final basic salary of AED 8,000 per month, and a total monthly wage (basic plus allowances) of AED 12,000.
- Daily wage: 8,000 divided by 30 = AED 266.67.
- First 5 years at 21 days: 266.67 x 21 x 5 = AED 28,000.
- Next 17 years at 30 days: 266.67 x 30 x 17 = AED 136,000.
- Raw total: AED 164,000.
- Cap check: 2 years of total wages = 12,000 x 24 = AED 288,000.
Ahmed's AED 164,000 is below the cap, so he receives it in full. The cap mostly bites when long service combines with a basic salary that forms a large share of total wages; for most employees it never activates, but always run the check on service beyond 15 to 20 years.
Estimate Your Gratuity Before You Resign
A five-minute pre-resignation checklist:
- Pull your exact basic salary from your registered contract or salary certificate, not from memory.
- Count your service in years, months and days from your contract start date, subtracting any unpaid leave.
- Apply 21 days per year for the first 5 years, 30 days per year after, pro rata for partial years beyond year one.
- Add notice pay (if applicable) and encashment of unused annual leave, both based on rules in your contract and the law.
- Compare your figure with HR's settlement sheet line by line before signing anything.
Who Qualifies, and What Changed Under the New Law
- You must be a full-time expatriate employee who completed at least one year of continuous service. UAE and GCC nationals are covered by mandatory pension schemes instead.
- Under the old law, resigning early from an unlimited contract could cut your gratuity to one third or two thirds. That reduction is gone: under the current law, resignation and termination earn the same gratuity. If you completed the year, you get the full 21 or 30-day calculation regardless of who ended the contract.
- Gratuity is still forfeited in narrow cases of lawful summary dismissal for grave misconduct under the statutory list, though the modern law has tightened how this can be applied.
- Part-time employees receive gratuity pro-rated to their working hours compared with full time.
- Your final settlement, including gratuity, should be paid within 14 days of your last working day.
The Effect of Unpaid Leave
Days of unpaid leave are excluded from the service period calculation. They do not break your continuity of service, but they do not count toward it either. If you took 3 months of unpaid leave across 5 years of employment, your gratuity is calculated on 4 years and 9 months of actual service. For most people this is a rounding issue; for employees who took long unpaid stretches, it noticeably reduces the payout, so keep records of any unpaid periods and check the employer's math.
Common Tricks and Mistakes to Watch For
- Calculating on total salary instead of basic: you cannot claim allowances, but equally an employer cannot retroactively re-label your salary to shrink the basic. The registered MOHRE contract governs.
- Artificially low basic salary: some employers structure packages as, say, AED 3,000 basic plus AED 7,000 allowances specifically to minimise gratuity and overtime. It is legal within limits, but you should price this into any offer you compare. Between two AED 10,000 packages, the one with the higher basic is worth thousands more per year of service.
- "Company policy" deductions: training bonds and genuine documented debts may be settled against your gratuity, but vague deductions for "processing", uniforms or visa costs are not lawful.
- Waiting out the payment: if your settlement does not arrive within a reasonable time after your exit, file a MOHRE complaint. It is free, fast and effective, and unresolved claims proceed to labour courts, with claims under AED 50,000 fast-tracked.
Gratuity Savings Schemes: The Modern Alternative
The UAE has been shifting toward funded end-of-service schemes. In the DIFC free zone, the DEWS plan replaced gratuity with monthly employer contributions (around 5.83 to 8.33 percent of basic salary) into an invested fund. A similar voluntary alternative scheme exists for mainland employers, where companies can opt in to monthly contributions instead of the traditional end-of-service lump sum. If your employer participates, your "gratuity" accumulates monthly in a portable savings plan; the rules above then apply only to service accrued before the switch. Ask HR which system covers you, and if it is a savings scheme, check your statements the way you would any investment account.
Before you resign or accept termination, run the numbers yourself using the formula above, compare them to HR's figure, and question any gap. Gratuity is frequently a five-figure amount in dirhams; ten minutes of arithmetic is the best-paid time of your notice period.
